Withdrawal from the purchase contract

Return of goods

If the purchase contract is concluded by means of distance communication (in an online shop), the consumer has the right to withdraw from the contract without giving any reason within 14 days of receipt of the goods (if the subject of the purchase contract is several types of goods or the delivery of several parts, this period runs from the date of receipt of the last delivery of the goods), in accordance with Section 1829(1) of the Civil Code. The withdrawal from the purchase contract must be sent to the seller within the period specified in the previous sentence.

The following conditions apply for the return of goods within 14 days of receipt:

  • If the consumer wishes to withdraw from the contract within 14 days according to the preceding paragraph, he/she shall contact the seller by telephone at 725 991 111 or write to the email address: info@pacho-lek.cz or to the address of the seller's registered office. He/she shall indicate the invoice number, his/her name, the account number for the refund and notify the withdrawal from the contract. Note: The money can also be returned in cash at the company's registered office or at one of the company's premises.
  • Once we know all these details, we will agree with you further details regarding the return or exchange of the goods.
  • The goods must be accompanied by proof of purchase: a receipt or invoice and a confirmed warranty card. The goods must be clean, undamaged, complete, without signs of use or wear and in their original packaging.
  • The goods must be delivered within 14 days from the date of receipt to the address.
  • Buyer pays for delivery to the Seller's address.
  • When exchanging or returning the goods, the customer is charged according to the law the actual costs associated with the exchange or return of the goods to their original condition (postage, replacement of damaged packaging or in case you request a refund by bank transfer also the rate according to the price list of the Czech Post. In the case of returning money by bank transfer, no fee is charged.
  • V případě, že kupující dle předchozích odstavců odstoupí od smlouvy, vrátí prodávající peněžní prostředky přijaté od kupujícího (kromě částky představující dodatečné náklady na dodání zboží vzniklé v důsledku kupující zvoleného způsobu dodání zboží, který je jiný než nejlevnější způsob standardního dodání zboží nabízený prodávajícím) do 14 dnů od odstoupení od kupní smlouvy kupujícím, a to stejným způsobem, jakým je prodávající od kupujícího přijal, pokud kupující neurčí jinak. Prodávající je taktéž oprávněn vrátit plnění poskytnuté kupujícím již při vrácení zboží kupujícím či jiným způsobem, pokud s tím kupující bude souhlasit a nevzniknou tím kupujícímu další náklady. Odstoupí-li kupující od kupní smlouvy, prodávající není povinen vrátit přijaté peněžní prostředky kupujícímu dříve, než mu kupující zboží vrátí nebo prokáže, že zboží prodávajícímu odeslal.
  • However, the provision of the Act on withdrawal within 14 days cannot be understood as a free loan of goods. If the consumer exercises the right of withdrawal within 14 days of receipt of the performance, he must, within 14 days of withdrawal, return to the seller everything he has received under the contract of sale. If this is no longer possible (e.g. the goods have been destroyed or consumed in the meantime), the consumer must provide monetary compensation in return for what can no longer be returned. If the returned goods are only partially damaged, the seller may claim damages from the consumer and set off his claim against the refunded purchase price. The seller must prove the damage in such a case. In such a case, the seller shall only refund the consumer the reduced purchase price.
  • The seller may offset the purchase price to be refunded against the costs actually incurred by the seller in returning the goods.
  • If all the above conditions for the return of the goods are met, the money for the goods will be sent by bank transfer or by bank transfer to the buyer's account within 14 working days after the physical receipt of the goods. In the event of non-delivery of complete goods or otherwise contrary to the above conditions, the deadline will be postponed until the delivery of full goods.

In the event of failure to meet any of the above conditions, the Seller will not accept withdrawal from the consumer contract and the goods will be returned at the Buyer's expense.

For all other purchases there is no legal entitlement to a "free" return as the goods can be viewed and tested before purchase. We offer the option to make arrangements by calling 725 991 111.

The consumer does not have the right to withdraw from the contract in accordance with § 1837 of the Civil Code, in particular in the case of contracts:

  • for the delivery of goods that have been modified according to the consumer's wishes or for the consumer's person,
  • for the provision of services, if they have been performed with the consumer's prior express consent before the expiry of the withdrawal period and the entrepreneur has informed the consumer before the conclusion of the contract that in such a case he has no right of withdrawal,
  • the repair or maintenance carried out at a place designated by the consumer at his request; however, this shall not apply in the case of subsequent repairs or the supply of spare parts other than those requested.
